Can a doctor force me to take antidepressants or psychiatric medication in South Africa?
No. Under Section 9 of the Mental Health Care Act 17 of 2002, you have the absolute right to refuse any treatment — including psychiatric medication — as a voluntary care user. What is the 72-hour assessment and what are my rights during it?
Under Section 33 of the Mental Health Care Act 17 of 2002, if you are admitted involuntarily, four designated mental health practitioners must independently assess you within 72 hours. You have the right to legal representation, the right to be assessed in your home language, and the right to appeal the outcome to the Mental Health Review Board.
Can my family have me committed without my consent?
Not without following the full legal process. A family member can apply to a court for an involuntary admission order, but this requires a formal application, independent medical assessments, and approval from the Mental Health Review Board.
